Agent Tek Hub LLC ("Company," "we," "us," or "our") operates the AgentTekHub platform at agenttekhub.com. This Privacy Policy describes how we collect, use, and protect your information when you use our service.

1. Information We Collect

Account Information

When you sign up, we collect:

• Name, email address, phone number
• Company/brokerage name
• MLS affiliation
• Billing and payment information (processed by Square)

Platform Usage Data

We automatically collect:

• Pages visited, features used, and actions taken within the platform
• Browser type, device type, IP address
• Login timestamps and session data

Tenant Client Data

As a platform provider, we store data that you (the tenant) collect through your AgentTekHub website, including:

• Lead and contact information (names, emails, phone numbers)
• Property search activity and saved searches
• Appointment bookings, webinar registrations
• Email and SMS communication logs

Important: You are the data controller for your clients' data. You are responsible for obtaining proper consent and maintaining your own privacy policy for your website visitors.

4. Data Security

We take reasonable measures to protect your data, including:

• SSL/TLS encryption for all data in transit
• Encrypted storage for sensitive data (passwords, API keys)
• Access controls and authentication for all admin areas
• Regular security updates to our platform

No system is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.

5. Data Retention

• Active accounts: We retain your data for as long as your account is active.
• After cancellation: We retain your data for 30 days after account cancellation to allow for reactivation or data export. After 30 days, your data will be permanently deleted.
• On request: You may request immediate deletion of your data by contacting us.
• Billing records: We retain billing and transaction records as required by tax and accounting law.

6. Your Rights

You have the right to:

• Access: View all personal data we hold about you
• Export: Download your contacts and data via CSV export at any time
• Correction: Update or correct your account information
• Deletion: Request deletion of your account and data
• Opt-out: Unsubscribe from marketing emails (service notifications are required while your account is active)

7. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act:

• Right to know what personal information we collect and how it is used
• Right to request deletion of your personal information
• Right to opt out of the sale of personal information (we do not sell personal information)
• Right to non-discrimination for exercising your privacy rights

8. CAN-SPAM Compliance

All emails sent through AgentTekHub include an unsubscribe mechanism. We process unsubscribe requests promptly. You agree to comply with CAN-SPAM requirements when sending emails through our platform.

9. SMS/Text Messaging

AgentTekHub provides SMS messaging capabilities through Twilio. When a tenant (agent or brokerage) enables SMS on their account, their clients may receive text messages including:

• Appointment reminders and showing confirmations
• New listing alerts matching saved search criteria
• Follow-up messages from their assigned agent
• Webinar and event reminders
• Drip campaign messages the client has opted into

Consent

SMS messages are only sent to individuals who have provided explicit, informed consent through a web form, registration page, or other documented opt-in mechanism on the tenant's AgentTekHub website. A clear disclosure is presented at the point of consent indicating that the individual agrees to receive text messages. Consent to receive text messages is not a condition of purchasing any property or receiving any service.

Opt-Out

Recipients may opt out of SMS messages at any time by replying STOP to any message. Upon receiving a STOP request, the system immediately and permanently ceases all SMS communication to that phone number. Recipients may reply HELP for assistance or contact the tenant directly.

Message Frequency

Message frequency varies based on the tenant's communication settings and the recipient's subscriptions. Typical frequency ranges from 1 to 10 messages per month.

Rates

Message and data rates may apply. Check with your wireless carrier for details about your text messaging plan. Carriers are not liable for delayed or undelivered messages.

Tenant Responsibility

Each tenant (agent or brokerage) is the data controller for their clients' phone numbers and SMS communications. Tenants are responsible for:

• Obtaining proper TCPA-compliant consent before sending any text messages
• Maintaining records of consent for each recipient
• Honoring all opt-out requests immediately
• Complying with all applicable federal, state, and local telecommunications regulations

Agent Tek Hub LLC provides the SMS infrastructure but does not control message content or recipient lists. Misuse of SMS capabilities may result in immediate account suspension.

10. Social Media Integration (Facebook & Instagram)

AgentTekHub allows tenants to connect their Facebook Pages and Instagram Business accounts to schedule and publish social media posts directly from the platform.

What We Access

When you connect your Facebook or Instagram account, we request the following permissions:

• pages_manage_posts — to publish posts on your Facebook Page on your behalf
• pages_read_engagement — to read post performance metrics
• instagram_basic — to identify your linked Instagram Business account
• instagram_content_publish — to publish posts to your Instagram Business account

What We Store

• Your Facebook Page name and Page ID
• Your Instagram Business account ID
• A long-lived Page access token (encrypted at rest in our database)

We do not access your personal Facebook profile, friend list, personal messages, photos, or any data beyond what is needed for Page and Instagram Business publishing.

Token Security

Access tokens are encrypted at rest and transmitted only over HTTPS. We perform daily automated health checks on stored tokens and notify you immediately if reconnection is needed due to token expiration or revocation.

Disconnecting

You may disconnect your Facebook and/or Instagram account at any time from your Settings page. Disconnecting immediately revokes our access and deletes the stored access token from our database. Previously published posts remain on your Facebook Page and Instagram account.

Compliance

Our use of Facebook and Instagram data complies with Meta's Platform Terms and Meta Developer Policies. We do not sell, share, or use Facebook or Instagram data for any purpose other than providing the social media publishing service you have authorized.

11. Children's Privacy

AgentTekHub is not directed at individuals under the age of 13. We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal information, we will delete it immediately.

12. Cookies

We use essential cookies for session management and authentication. These are necessary for the platform to function. We do not use third-party tracking cookies or advertising cookies.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email. The "Last updated" date at the top reflects the most recent revision.
